AN ORDINANCE OF THE JACKSON PARISH POLICE JURY FIXING SPEED LIMITS ON PARISH ROADS, PROVIDING FOR PENALTIES AND PROVIDING FOR MATTERS RELATED THERETO.

WHEREAS, the Jackson Parish Police Jury desires to specifically fix the speed limits on all roads situated in Jackson Parish which are not state highways and which are not located within the municipal limits of any municipality and to provide for penalties for the violation of the maximum speed so established:
NOW, THEREFORE, be it ordained by the Police Jury of Jackson Parish, Louisiana, in regular session, duly convened on the 8th day of December, 2008, that the following Ordinance be and the same is hereby adopted:

SECTION 1: Definitions
For the purposes of this Ordinance the following term shall have the following definition:
A) Parish Road:  Any road, whether paved, gravel or dirt, maintained by the Jackson Parish Police Jury or in the road system of the Jackson Parish Police Jury which is not located within the municipal limits of any municipality.  Parish road shall not include any paved highway which is a portion of the state highway system.

SECTION 2: Maximum Speed
It shall be illegal to operate any motor vehicle, as defined by Louisiana law, on a parish road at a speed in excess of 35 miles per hour.

SECTION 3: Penalty
Any individual who operates a motor vehicle on a parish road at a speed in excess of 35 miles per hour shall be guilty of a violation of this Ordinance.  For each such violation the individual shall be subject to a fine of not more than $500.00 and/or imprisonment for not more than sixty (60) days in the parish jail or both.  In addition, to the fine and imprisonment set forth herein, any violator of this Ordinance shall be subject to being compelled to pay all court costs.

SECTION 4: Effective Date
This ordinance shall become effective immediately upon its adoption.

SECTION 5: Severability
Severability is intended throughout and within the provisions of this Ordinance.  Should any item or provision, including any section, exception, part, phrase or term, or the application thereof be held invalid, the application to other persons or circumstances shall not be affected thereby and the validity of this Ordinance in any and all other respects shall not affected thereby.  If any phrase, clause, word, or portion of this Ordinance is held to be invalid or unconstitutional by any court of competent jurisdiction, the invalidity shall be limited to that portion of the Ordinance.   

All ordinances or parts of ordinance in conflict herewith are repealed as of the effective date of this Ordinance.

Upon motion made by Mr. Langston and seconded by Mr. Smith the above ordinance was adopted at the legal meeting of the Police Jury of Jackson Parish, Louisiana held on the 8th day of December 2008, by the following vote:
